Terms of Use

1. Introduction

1.1 These Online Terms govern:

• your use of the Caymanite Capital website, application and platform;
• the creation and operation of your account;
• any application made by you for a loan; and
• all communications between you and us before any Loan Agreement is entered into.

1.2 By creating an account, accessing the Platform or submitting an application, you agree to be bound by these Online Terms.

2. Eligibility

2.1 You represent that:

• you are at least 18 years of age;
• you are lawfully resident in the Cayman Islands;
• you are legally entitled to work in the Cayman Islands;
• you maintain a bank account in your own name; and
• you have a regular source of income.

2.2 You must notify us immediately if any of the above ceases to be true.

3. Applications

3.1 An application submitted through the Platform is a request for us to consider providing credit.

3.2 An application does not oblige us to offer a loan.

3.3 We may approve or decline any application for any lawful reason.

3.4 No loan exists until a Loan Agreement has been signed by both parties.

3.5 We may delay, suspend or refuse funding of any approved application where we reasonably suspect fraud, identity theft, money laundering, sanctions concerns, misrepresentation or other unlawful activity and may require further verification before releasing funds.

4. Identity Verification, KYC and AML

4.1 You authorise us to verify your identity.

4.2 You authorise us to carry out:

• anti-money laundering checks;
• sanctions screening;
• politically exposed person screening;
• relatives and close associates screening;
• adverse media screening;
• fraud prevention checks;
• identity verification checks;
• document authentication checks;
• facial recognition and liveness verification checks;
• watchlist screening; and
• ongoing monitoring.

4.3 You authorise us to use third-party identity verification, fraud prevention, anti-money laundering, sanctions screening, politically exposed person screening, adverse media screening and document authentication service providers in connection with your application and any loan.

4.4 We may request further information or documentation at any time.

4.5 Failure to provide requested information may result in suspension of your account or refusal of an application.

5. Employment Verification

5.1 You authorise us to contact your employer directly.

5.2 You authorise us to obtain confirmation of:

• your employment status;
• your position;
• your salary;
• your period of employment; and
• any other information reasonably required to assess your application.

5.3 You acknowledge that employment verification may occur before and after a loan is issued.

6. Affordability Assessment

6.1 You authorise us to assess your ability to repay any loan.

6.2 We may require:

• bank statements;
• payslips;
• employment letters; and
• evidence of existing liabilities.

6.3 We may use third-party service providers when performing affordability assessments.

7. Information Accuracy

7.1 All information supplied by you must be true, accurate and complete.

7.2 You must not submit forged, altered or misleading documents.

7.3 You must promptly notify us if information previously supplied becomes inaccurate.

8. Account Security

8.1 You are responsible for maintaining the confidentiality of your login credentials.

8.2 Activity conducted through your account will be treated as authorised by you unless we have reason to believe otherwise.

9. Privacy

9.1 Our Privacy Policy explains how we collect, process, use and share personal information.

9.2 By using the Platform, you acknowledge that you have read the Privacy Policy.

10. Suspension and Termination

10.1 We may suspend or terminate an account if:

• false information has been provided;
• fraud is suspected;
• verification cannot be completed;
• these Online Terms are breached; or
• we are required to do so by law.

11. Governing Law

11.1 These Online Terms are governed by the laws of the Cayman Islands.

11.2 The courts of the Cayman Islands shall have jurisdiction over disputes arising from these Online Terms.
